Medical Cannabis Update For Probationers

Upon hearing from so many of you affected by SB 423’s ban on people on probation from participating in the state medical marijuana program, MTCIA contacted the Goetz Law Firm to request a document asserting that provision’s unconstitutionality.

Many department of corrections employees probably realize the moral and legal aspects involved in aggressively enforcing their interpretation of this new prohibition, but we have heard that some probation officers are demanding the surrender of medical marijuana cards and metabolite-free urine samples.

We offer the following memo to individuals that may be affected, in case it helps your situation:

People on probation should also consider assisting with the referendum effort being conducted by Patients For Reform — Not Repeal, which has as its goal the suspension of the entirety of SB 423, which would end the prohibition on probationers.
